6. User Content

You retain ownership of any content you submit, post, or transmit through the Services ("User Content"). By submitting User Content, you grant Kiloki Communications a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely as necessary to provide the Services.

You are solely responsible for your User Content and represent that you have all necessary rights to submit it and that it does not violate any law or third-party right.

7. Intellectual Property

All rights, title, and interest in and to the Services — including software, design, trademarks, logos, and content we provide (excluding User Content) — are and remain the exclusive property of Kiloki Communications and its licensors. To the fullest extent permitted by applicable law, Kiloki Communications and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Services, even if advised of the possibility of such damages.

Our total aggregate liability for any claim arising from these Terms or the Services will not exceed the amount you paid us in the twelve (12) months preceding the claim, or CAD $100 if you have not paid us any amount.

Nothing in these Terms limits liability that cannot be excluded or limited under applicable Canadian consumer-protection law.

11. Indemnification

You agree to indemnify and hold harmless Kiloki Communications from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Services, your User Content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Services or close your account at any time. We may suspend or terminate your access to the Services, with or without notice, if you violate these Terms or if we reasonably believe termination is necessary to protect the Services, other users, or Kiloki Communications.

Upon termination, your right to use the Services ends immediately; provisions of these Terms that by their nature should survive (e.g., intellectual property, limitation of liability, indemnification) will continue to apply.
